Zuvia Terms of Service
Please read these terms carefully. By using Zuvia, you agree to follow our rules and respect our community.
1. Agreement to Terms
Welcome to Zuvia. These Terms of Service ("Terms") govern your access to and use of the Zuvia mobile application and services ("Service"). By accessing or using our Service, you agree to be bound by these Terms in accordance with the laws applicable in the Republic of Cameroon. If you disagree with any part of the Terms, you do not have permission to access the Service.
2. Definitions
refers to the owner and operator of the mobile application.
refers to the person accessing or using the Service.
refers to all information and materials made available through our Service, including listings, descriptions, images, messages, and comments.
refers to an item or service offered for sale or purchase on our platform.
refers to the exchange of goods or services between Users facilitated through our Service.
3. Use of Service
3.1 Eligibility
You must be at least 18 years old and capable of forming a binding contract to use our Service. By using our Service, you represent and warrant that you meet these requirements.
3.2 User Account
To use certain features of our Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3.3 Prohibited Uses
You agree not to:
- Use the Service in any way that violates any applicable law or regulation in Cameroon
- Post false, misleading, or fraudulent content
- Impersonate any person or entity
- Interfere with the proper functioning of the Service
- Attempt to gain unauthorized access to our systems
- Transmit harmful code or malware
- Collect user data without consent
4. Listings and Transactions
4.1 Listing Content
Users posting listings represent and warrant that:
- They have the legal right to sell the items or services
- Listings accurately describe the items or services
- Listings comply with all applicable laws in Cameroon
- Items listed are not counterfeit, stolen, or otherwise illegal
4.2 Prohibited Items
Users may not list items that are:
- Illegal under Cameroonian law
- Dangerous, hazardous, or harmful
- Counterfeit or violate intellectual property rights
- Stolen or fraudulently obtained
- Adult content or sexually explicit materials
- Weapons, ammunition, or explosives
- Human remains or body parts
- Fraudulent documents or identification
- Wildlife, protected species, or products derived from them
4.3 Store Management
Users may create stores to manage multiple listings. Store owners are responsible for:
- Maintaining accurate store information and branding
- Managing all listings associated with their store
- Ensuring store content complies with our policies
4.4 Boost Services
Users may purchase boost services to increase listing visibility. Boost services are non-refundable and subject to availability. Zuvia does not guarantee specific results from boost services.
4.5 Transaction Responsibility
Zuvia is a platform that facilitates connections between buyers and sellers. We are not a party to transactions. Users are responsible for:
- Negotiating terms of transactions
- Fulfilling obligations related to transactions
- Addressing any issues or disputes arising from transactions
5. Fees and Payments
5.1 Service Fees
Zuvia may charge fees for certain features or services. Applicable fees will be clearly communicated before they are incurred.
5.2 Payment Methods
We support MTN Mobile Money and Orange Money for transactions and fees. By using these payment services, you agree to comply with their respective terms and conditions. All payments are processed securely through trusted mobile money providers.
5.3 Currency
All payments and transactions on Zuvia are in CFA Francs (FCFA), the official currency of Cameroon.
5.4 Taxes
Users are responsible for paying all applicable taxes related to their use of the Service and transactions conducted through it, in accordance with Cameroonian tax regulations.
6. Intellectual Property Rights
6.1 Zuvia Content
The Service and its original content, features, and functionality are owned by Zuvia and are protected by international copyright, trademark, and other intellectual property laws.
6.2 User Content
By posting content on our Service, you grant Zuvia a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display such content in connection with providing and promoting the Service.
6.3 Reporting Infringement
If you believe content on our Service infringes intellectual property rights, please contact us with detailed information about the alleged infringement.
6.4 Data Collection
We collect and process data such as listing view counts, user interactions, and platform usage statistics to improve our services and provide insights to users about their listings.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without any warranties, either express or implied. Zuvia disclaims all warranties, including but not limited to:
- Merchantability and fitness for a particular purpose
- Availability, reliability, or accuracy of the Service
- Quality, safety, or legality of items listed on the Service
- Security of information transmitted through the Service
- Success, value, or reliability of any transaction conducted through the Service
8. Limitation of Liability
To the fullest extent permitted by law, Zuvia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your access to or use of the Service.
Our total liability for any claims arising under these Terms shall not exceed the greater of the amount you have paid to Zuvia for use of the Service or 10,000 FCFA.
9. Indemnification
You agree to indemnify, defend, and hold harmless Zuvia and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you post or transmit through the Service
10. Governing Law and Dispute Resolution
10.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Cameroon.
10.2 Dispute Resolution
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiation. If such negotiation fails, the dispute shall be submitted to the competent courts in Cameroon.
